GENERAL SUBSCRIPTION TERMS AND CONDITIONS

Article 1. Definitions

In these terms and conditions, the following terms shall have the following meanings:

  • Subscriber: The individual or business entity that enters into a Subscription with Trading Union LLP.

  • Subscription: An agreement for the provision of access to Trading Union LLP’s SaaS platform and digital tools.

  • Subscription Fee: The applicable fee that the Subscriber owes to Trading Union LLP for the Subscription.

  • Billing Period: The period during which the Subscription Fee must be paid by the Subscriber.

  • Consumer: A Subscriber who is a natural person and does not act in the course of a profession or business.

  • Platform: The digital software services, analytical tools, documentation, and resources provided by Trading Union LLP.

  • Trading Union LLP: The provider of the SaaS platform, registered at Kinburn street 32, SE16 6DW, under registration number OC445863.

  • Terms: These General Subscription Terms and Conditions.

Article 2. Applicability

  1. These Terms apply to all Subscriptions, agreements, and services provided by Trading Union LLP.

  2. Any deviations from these Terms are only valid if expressly agreed upon in writing.

  3. Subscriber agrees that these Terms apply to all subsequent agreements between the Subscriber and Trading Union LLP.

  4. Trading Union LLP reserves the right to amend these Terms. Changes will be communicated in advance, and continued use of the Subscription implies acceptance.

Article 3. Subscription & Access

  1. Subscriptions grant access to the Platform upon payment confirmation.

  2. Subscription plans are available on a monthly or quarterly basis, as selected during checkout.

  3. The Subscription renews automatically unless canceled before the next Billing Period.

  4. Subscriber receives immediate access to the Platform upon successful payment.

Article 4. Pricing & Payments

  1. Prices are stated in Euros (€) and may be subject to VAT.

  2. Payment methods accepted: Credit Card, Apple Pay, Google Pay.

  3. Subscriptions are prepaid and charged at the beginning of each Billing Period.

  4. Trading Union LLP reserves the right to adjust Subscription Fees with prior notice.

  5. Failure to process a payment will result in suspension of access until the outstanding balance is settled.

Article 5. Refund Policy

  1. All offers have a 14 day refund policy if the product is not what you expected of it.

  2. If a Subscriber cancels their Subscription, they will retain access until the end of the current Billing Period.

  3. Refund exceptions apply only in cases of billing errors caused by Trading Union LLP.

Article 6. Cancellation & Termination

  1. Subscribers may cancel their Subscription at any time through their account settings.

  2. Monthly subscriptions: Can be canceled at any time but must be done at least one day before renewal to avoid the next charge. Your membership will expire after 3 months.

  3. Quarterly subscriptions: Can be canceled after the minimum term of 3 months.

  4. If a Subscription is canceled, no further charges will be made, and access will remain available until the end of the Billing Period.

  5. Trading Union LLP reserves the right to terminate an account in case of policy violations or fraudulent activity.

Article 7. Access & Usage Rights

  1. Subscriber is granted a non-exclusive, non-transferable, revocable license to access the Platform.

  2. Sharing login credentials or sublicensing the Platform is strictly prohibited.

  3. Subscriber is responsible for maintaining the confidentiality of their account credentials.

Article 8. Intellectual Property Rights

  1. All intellectual property rights associated with the Platform and its contents remain the property of Trading Union LLP or its licensors.

  2. Unauthorized reproduction, distribution, or modification of Platform content is strictly prohibited.

  3. Violation of this clause may result in immediate termination of access and legal action.

Article 9. Liability & Disclaimers

  1. Trading Union LLP provides the Platform on an "as is" basis and does not guarantee uninterrupted service.

  2. Trading Union LLP is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform.

  3. Subscribers are responsible for ensuring their own compliance with applicable laws when using the Platform.

Article 10. Privacy & Data Protection

  1. Subscriber data is processed in accordance with Trading Union LLP’s Privacy Policy, available at www.tradingunion.network/privacy-policy.

  2. Trading Union LLP implements appropriate security measures to protect user data.

  3. Personal data is not shared with third parties unless required by law.

Article 11. Force Majeure

  1. Trading Union LLP is not liable for service interruptions due to force majeure, including but not limited to natural disasters, technical failures, cyberattacks, or regulatory restrictions.

  2. If force majeure prevents service for more than 30 days, both parties may terminate the Subscription without liability.

Article 12. Amendments & Final Provisions

  1. Trading Union LLP reserves the right to update these Terms. Subscribers will be notified of changes.

  2. Any dispute arising under these Terms shall be governed by United Kingdom & Dutch law.

  3. Any disputes arising from or in connection with these terms and conditions shall be submitted to the competent court in the jurisdiction where the customer is domiciled..
